Agreement of the Government of the State of Jalisco establishing measures to strengthen social isolation

A. WHAT MEASURES DOES THE AGREEMENT ESTABLISH?
- Obligatory isolation at home for every person who is in the state of Jalisco.
- Strict and unexceptional isolation at home for vulnerable groups (over 60 years of age, with diabetes, hypertension, lung or heart disease, kidney or liver failure and with immunosuppression).
- It reiterates the non-essential activities suspension.
- The obligation for those who continue to perform essential activities to respect the health measures that have been recommended.ç
- It establishes the obligation to use face masks for people on public roads or performing essential activities.
- It suspends the celebration of patron saint, civic or community festivities.
- It prohibits the use of public spaces such as sports units, squares and municipal gardens.
B. WHO WILL SUPERVISE THE COMPLIANCE OF THE NEW SOCIAL ISOLATION PROVISIONS?
- The agreement empowers the municipal authorities to verify compliance with these new measures.
C. WHAT SANCTIONS ARE ESTABLISHED IN THE AGREEMENT FOR ANYONE WHO VIOLATES THE ABOVE MEASURES?
- The violation of the measures set out in the agreement may be punished by warnings, fines, temporary or permanent closures and arrests of up to 36 hours.
D. WHAT IS THE DURATION OF THESE NEW MEASURES OF SOCIAL ISOLATION
- The new measures will be in force until May 17th, 2020, with the possibility of extending their application if necessary.
E. HOW DOES THE AGREEMENT IMPACT ME IF MY COMPANY IS ENGAGED IN NON-ESSENTIAL ACTIVITIES?
- If your company is engaged in non-essentials activities, you must have already suspended activities, or you must suspend them immediately.
- The suspension must be executed in an agreement with your employees detailing the cause of the suspension, its duration and the compensation to be paid to the employees during the suspension period, which will be up to one month’s salary.
- It is necessary that if some employees will continue to work, the conditions under which they will do so must be documented in home office agreements.
F. HOW DOES THE AGREEMENT IMPACT ME IF MY COMPANY IS ENGAGED IN ESSENTIAL ACTIVITIES?
- In view of the increase in inspections and visits to companies, it is necessary to have the documentation to prove that the company is engaged in an essential activity or that is part of a supply chain of an essential activity in order to continue operating.
- It is necessary that the previous document includes the articles of incoporation, service provision agreements, letters from clients, invoices, commercial activity licenses or any other document that proves that the company perform essential activities or forms part of the supply chain of an essential activity company.
- Evidence must be provided that health measures are being respected, that no employees from vulnerable groups are working, that there are no more than 50 employees.
- It is necessary that all the employees who will continue working have face masks or repirators in the execution of their work.
- A document must be issued to the employees stating that they will continue to work in a company that perform essential activities and that they may therefore circulate on public roads, in the event that any authority requires them such document.
