Hague Agreement Concerning the International Registration of Industrial Designs

On June 5, 2020, the Mexican Office of Industrial Property (“IMPI”), published the Agreement establishing the rules and specifications to file and process applications and documentation under the Hague Agreement concerning the International Registration of Industrial Designs, before the IMPI, in the Official Gazette of the Federation.
On March 6, 2020 Mexico entered into the Hague Agreement Concerning the International Registration of Industrial Designs by depositing the Agreement with the Director General of the World Intellectual Property Organization (“WIPO”). Therefore, the Agreement, in accordance with its protocols, the international procedure for the protection of Industrial Designs entered into force in Mexico on June 6, 2020.
The Hague Agreement Concerning the International Registration of Industrial Designs allows for the protection of industrial designs by filing a single application designating the countries that are part of this Agreement. Very similarly to what happens with patents through the application of the international patent system derived from the Patent Cooperation Treaty (PCT) or for trademarks under the Madrid Agreement and Protocol.
With the publication of these rules, the use of the Agreement for owners (creators) of industrial designs in Mexico will become feasible.
