Modifications to the Foreign Trade General Rules.

The third resolution of modifications to the Foreign Trade General Rules for 2020 (“FTGR 2020”) was published.

What was modified?

1. Events for suspension with the Importers´ Registries’.

Companies can be suspended from the importers registries’ when they have carried out transactions with third parties (individuals or legal entities) published in the definitive list of companies that invoice non-existing operations, in terms of article 69-B of the Federal Tax Code, without having evidenced the materiality of said operations, or without haven corrected their tax situation.

2. Rectification of pedimentos

It was determined that, in order to request the rectification of the data declared in the pedimento, the requesting company must be in compliance with its tax obligations, have a locatable address and have a tax mailbox.

3. Commercial information numbers (NICO)

a) The term NICO was included in the applicable dispositions of the FTGR 2020, as well as in the corresponding tariff items.

b) The procedure to cancel the suspension of the customs electronic system, derived from the incorrect declaration of a NICO, in terms of the article 184-C of the Customs Law, was included.

4. Fines

The amounts of fines to be paid during the year 2021 in accordance with the Customs Law, are updated.
